To get your deposit back on time: photograph the entire apartment before you move out. Doors, walls, kitchen, bathroom, windows, and floors included. Date-stamped photos are valid as legal evidence.
Early Termination: Is There a Penalty?
If you want to move out before the lease ends, you have three options:
- Early termination clause: Your lease may have a clause that lets you leave freely in exchange for 1-2 months' rent as penalty. If this clause exists and was mutually agreed on, you can use it.
- Re-let the unit: Work out an agreement with the landlord to find a new tenant. After a new tenant is found, your responsibility ends (in some states the landlord is required to accept this).
- Subletting: If your lease allows it, you can sublet to someone else. But the responsibility still stays with you.
Warning, Landlord Entry Rights: In the US, when the landlord wants to visit for repairs or inspections, they are required to give advance notice (usually 24-48 hours). Except for emergencies (burst pipe, fire hazard), entering without permission violates your rights. In New Jersey, 24 hours advance notice is mandatory.
Which Costs Are the Tenant's, Which Are the Landlord's?
As a standard in American lease agreements:
Tenant's Responsibility:
- Light bulb replacement
- Repair of damage you caused
- Renters insurance
- In some leases, cleaning the plumbing in your unit
Landlord's Responsibility:
- Structural repairs (wall, ceiling, floor damage)
- HVAC, water heater, major appliances (if provided)
- Water/electric infrastructure issues
- Maintaining livable conditions (habitability standards)
Renters Insurance: Most Landlords Require It Now
Renters insurance protects your personal belongings (laptop, furniture, clothes) against theft or fire. It also protects you from liability risk if someone gets injured in your home. It costs about $10-20 a month, which is very affordable, and most landlords now require it.
For those coming from Turkey, SSN and credit history: When you first arrive, the landlord will want to run a background check. If you don't have an SSN, offering your passport, bank account statement, and 2-3 months of rent upfront usually helps you get past this obstacle. Some landlords also accept a background check with an ITIN.
